“Marco Civil” debates new rules of Internet use in Brazil


Government makes public consultation to define complicated points of law that defines Internet use in Brazil

The Marco Civil is specific legislation that stablishes principles, guarantees, rights and duties of Internet users in Brazil. It was established through the Law nº 12.965/2014 approved in April last year. It is guided by three key pillars: network neutrality, freedom of expression and user privacy. From Wednesday, January 28, the Brazilian government launches another public consultation process through a portal, which aims to receive suggestions and proposals of citizens, using the Internet itself as a discussion platform. Contributions may be presented in the next 30 days. The debate takes place within the following areas:

Neutrality: This axis will discuss the technical requirements for the provision of appropriate services and should deal only with situations where the net neutrality can be left aside, that means, define what can be considered an exceptional cases, an emergency service.

Network privacy: this axis should clear principles and rules that guarantee the privacy of network users. Security and transparency of procedures shall also be better specified.

Access Log: keep the access logs can uncover crimes committed on the Internet, for example. Establish the obligations of the responsibles and procedures relating to records are the talking points of this axis.

Other issues: this is an axe where civil society can propose topics not specified in the above axes.
